The decision of the Council of State to suspend the decree establishing technical inspection on January 1, 2023 does not change anything in substance!

In a press release published Tuesday May 17, the Council of State, contacted by the Respire, Ras-le-Scoot and Paris sans automobile associations, suspends the postponement until January 1, 2023 of the implementation of motorcycle technical inspection (CT), initially set by a decree of January 9, 2021. August XNUMX.

Last summer, the government announced its intention not to impose MOT on 2WD vehicles by proposing alternative measures as permitted by European directive 2014/45/EU. The new decree establishing these provisions has still not been signed.

The FFMC and the FFM point out that motorcycle technical inspections have no interest in improving road safety (less than 0.4% of motorized two-wheeler (2WD) accidents are linked to a technical failure of the vehicle).

In any case, this decision does not call into question anything in substance, it only suspends the date of application of the decree of August 9, 2021; Furthermore, a request for an exemption was sent by the French State to the European Commission on December 3, 2021.

Faced with this decision by the Council of State, the FFMC and the FFM will contact the next Minister of Transport upon his appointment in order to obtain confirmation of the State's commitments.

It therefore becomes urgent that the State takes its responsibilities in order to repeal the decree of August 9 to implement the alternatives transmitted to the European Commission.

The FFMC and the FFM remain vigilant regarding the rest of the procedure and do not rule out implementing actions of all kinds.
